Giddings Police Report

April 18, 2005

Officer Valles, while patrolling the 2300 blk. of N. Main St., observed a red Ford pick-up parked in the Giddings High School parking lot. Officer Valles observed a Hispanic male, ID’d as Roberto Montoya hanging out of the driver’s side window. A 2nd Hispanic male ID’d as Matin Jimenes was observed in the passenger seat and a 3rd Hispanic male ID’d as Matin Barrientos Perez. A strong odor of alcohol emitted from the vehicle. All three had slurred speech and did not know where they were. When asked, they thought they were in Waco, TX. All admitted to drinking several alcoholic beverages as they drove, before getting lost in the Giddings High School parking lot.. All were arrested for public intoxication and transported to the GPD where they were booked into the jail without incident.

Sr. Patrolman Taylor was notified by dispatch of a woman wanting to report a stolen bike. Patrolman Taylor spoke with the woman identified as Karen Dunaway. She stated that she noticed the bike missing on April 18th at 8:00 a.m. Investigation is currently underway.

Cpl. Ramirez met with a complainant ID’d as Mario Murillo at the Giddings PD in reference to his missing cell phone. The only information on the phone is a Verizon flip phone. . The value of the phone is approximately $300. Case pending further investigation.

April 19, 2005

Sr.Patrolman Taylor received a call in reference to a burglary of a motor vehicle. Upon arrival at the PD, Patrolman Taylor spoke with Candy Marie Clark in reference to her daughter’s 2002 blue Volkswagon Beetle that was broken into on April 18th at the Giddings High School student parking lot. Clark stated that her daughter, and some friends left campus to have lunch and returned to the campus at 12:45 p.m., Her daughter discovered items missing from the vehicle. Clark was issued an incident report number. Case under investigation.

Sgt. Harney received a call from dispatch in reference to a theft of gas in the amount of $39.00 that occurred at Buc-ee’s Convenience Store. The description of the vehicle given by dispatch was a white Chev. Pickup bearing TX LP #6YR-J22 last seen traveling westbound on E. Austin St. Sgt. Harney was unable to locate the vehicle, but will attempt to contact registered owner by telephone. Case pending investigation.

Sgt. Harney was dispatched to meet a complainant at the PD in reference to burglary of a vehicle that took place on the 18th of April at the High School parking lot. The complainant, ID’d as Deborah Frosch Lehmann, said that her son drove their tan F-250 King Ranch Pickup to school and did not lock the truck when he went to class. After school, he noticed that the radar detector was missing. The radar detector was valued at approximately $300. Case pending investigation.

April 20, 1005

Officer Carvin was dispatched to the Cellular One store, located at 2437 E. Austin St., in reference to a disturbance that had just occurred. Officer Carvin met with the complainant, Diane McMillan, who stated that the assault victim was at the back of the store. The officers met with the victim, ID’d as Synthia Bell, who was sitting on the curb and was visibly shaken and crying. Officer Carvin asked Ms. Bell what happened and she stated that her boyfriend, ID’d as James Mathis, had come to the store while she was waiting on a customer. The female customer and Mr. Mathis knew each other and began arguing. Mr. Mathis left then came back to the store a short time later and asked Ms. Bell to speak with him outside. According to Ms. Bell and Ms. McMillan, Mr. Mathis became very angry and got into his vehicle. Ms. Bell was leaning into Mr. Mathis’ window when he began backing out. Ms. Bell’s shoulder struck the mirror, bending the mirror back. Mr. Mathis accused her of bending the mirror on purpose. Mr. Mathis then threatened to damage Ms. Bell’s vehicle that was parked behind the builidng. The complainants walked to the back of the store and observed Mr. Mathis approaching Ms. Bell’s vehicle. Ms. Bell then pushed Mr. Mathis away from her vehicle. Mr. Mathis pushed her to the ground, leaving scratches to her waist, hips and back. He got into his vehicle and began to drive away from the scene when Ms. Bell ran to his truck and began hitting him on or about his face. The officers spoke with Mr. Mathis who gave a similar account of the incident. It appears both parties involved were guilty of assault. This case will be further investigated before charges are filed.

April 21, 2005

Chief Lapham and Officer Carvin arrived at a local bank to investigate a counterfeit bill recovered by one of the bank employees. This currency was recovered on or about March 31,2005. The president of the bank did release the currency to Chief Lapham. Follow-up investigation is being conducted. This case will remain open and the currency shall be forwarded to the Secret Service Counterfeit Office. Case remains open.

Chief Lapham and officer Carvin assisted the city’s Animal Control Officers who were investigating the sale of under aged puppies. Animal Control spoke with the persons on the premises. Assistance in this matter was not needed due to cooperative involvement of all parties.

Chief Lapham met with the principal of the Giddings Middle School, Mr. Shane Holman. Mr. Holman came by the station to inform officers of an incident which involved approximately 3 students involved in an altercation. He stated that his school had no prior knowledge that there was a problem existing between the students. He wanted to report this incident to the police in the event that one or more of the parents came to the GPD to file a report.

Officer Valles met with Kimberly McClain at the GPD regarding the previously reported assault at GMS. She stated that her son had been grabbed by a juvenile and held as another juvenile was punching him in the abdomen. He was slammed to the ground and one of the juveniles stood on his back. She stated that in addition to these, two others had also been harassing her son for several weeks. Ms. McClain wants to pursue charges against the juveniles and signed complaints. Written statements and pictures of the injuries were taken.

Officer Law met with Colby Allen Caruthers in reference to terroristic threats made by Justin Hall. Caruthers stated that Hall made the statement that he (Caruthers) had signed his own death warrant and that he had a gun. Caruthers did not wish to pursue charges at this time, but wanted the threats to stop. Officer Law spoke with Hall at his residence and he stated that he did not threaten Caruthers, but they did have a verbal altercation several days ago. He was advisednot to have any contact with Caruthers. Hall advised that he understopod. Case cleared.

April 22, 2005

Sr. Patrolman Taylor received a call in reference to disorderly conduct fighting at the GHS. Upon arrival at GHS, Patrolman Taylor met with Mr. Franco, the assistant principal. Franco explained that both students had a fight inside the HS boys restroom. Both juveniles were issued citations for disorderly conduct fighting. Case closed – both juveniles issued citations.

Cpl. Ramirez conducted a traffic stop on a maroon 1999 Dodge Durango bearing TX LP # T26-TZX, at the 100 blk. of East Hempstead St. for displaying an expired registration sticker, expired on 04-04. Upon making contact with the driver, Cpl. Ramirez asked for his drivers license and proof of insurance. The subject, ID’d as Michael Mayberry, stated that his drivers license was expired. A check on his name and date of birth through TCIC and NCIC revealed that he does have a drivers license under his name. The license expired on 11-14-89. Mr. Mayberry also stated that he could not find his insurance. Mr. Mayberry was placed under arrest for no drivers license and failure to maintain financial responsibility and displaying expired motor vehicle registration sticker. AJ’s wrecker on next rotation was called to tow and store the vehicle. Mr. Mayberry was transported to the GPD for booking process and secured in a cell without incident. Case cleared by arrest.

Cpl. Ramirez was dispatched to the GPD to speak with a complainant on the phone at the GPD. The complainant, Ms. Lakesha Haywood, was contacted via telephone. She stated that she was at the Brookshire Bros. In Giddings with a male subject ID’d as Alex Bradshaw. Ms. Haywood went inside and left $100 in her purse in the car along with Alex Bradshaw. Ms. Haywood stated that she dropped off Bradshaw . When she arrived at work, she noticed that she was missing $100 out of her purse. She stated that she wished to pursue charges, Case pending further investigation.

April 23, 2005

Officer Crockett and Cpl. Ramirez with the GPD were dispatched to 391 West Brenham for an assault complaint. Upon arrival, a female was identified crying, stating she had been assaulted. She was ID’d as Chasica Justice. Ms. Justice stated that she wanted to go to the hospital due to being in pain. She stated that she had not been drinking and she did not do drugs. Cpl. Ramirez advised dispatch to have EMS in route to the location. While speaking with Ms. Justice, she stated that her fiance, Charles Blue, beat her up. She stated that the incident occurred at Charles Blue’s grandmother’s house located at 473 N. Caldwell St. She stated that Charles Blue punched her various times in the stomach and in the ribs. Ms. Justice stated that Charles choked her until she passed out. Cpl. Ramirez took pictures of Ms. Justice’s neck, stomach and back. She stated that the assault occurred approximately 30 minutes before the officers arrived. Ms. Justice did not have any physical red marks around her throat or any red marks on her body where she stated she had been hit. She stated that when she woke up she ran to 391 W. Brenham and asked the resident of the house to use their phone. Ms. Justice was advised that after she went to the hospital she would need to come to the GPD to provide a written statement. Case pending further investigation.

Cpl. Anthony Ramirez and Officer Nashanda Crockett were dispatched to the area of 312 S. Polk St. in reference to a possible intoxicated driver. The complainant ID’d as Jennifer Rodea stated that Charles Blue was at her residence causing a disturbance and he left in a gold colored Chevrolet Neon and stated that he had been drinking. The officers searched the area and were unable to locate the vehicle. They arrived at the residence and spoke with Ms. Rodea. Ms. Rodea stated that she just wanted a criminal trespass warning issued to Mr. Blue. The officers attempted to locate Mr. Blue. He was found in front of Shooties Bar located at 184 W. Austin St. Mr. Blue was asked what taken place and he stated that he went to the residence and attempted to gather his clothes, but left the residence. He stated that they had once dated, but broke the relationship off. Mr. Blue was informed that if he wanted his belongings from the residence, the officer would have Ms. Rodea pack his stuff and the officer would take it to Mr. Blue, so he would have no reason to return to her residence. He agreed. Mr. Blue was issued a criminal trespass warning and he agreed that he would not return to the residence anymore. No odor of an alcoholic beverage was detected and Mr. Blue had clear eyes. Case clear – information only.

Cpl. Ramirez conducted a traffic stop on a silver Pontiac Grand Prix 4-door bearing TX LP #W40-PRK, at the 1600 blk. of East Austin St. for a defective left headlamp not illuminating. Upon making contact with the driver, Cpl. Ramirez asked the male subject for his drivers license and proof of liability insurance and he stated that he did not have a drivers license. The subject was identified as Juan Miguel Hernandez with the use of his Mexico ID card. A check on his name and date of birth through TCIC and NCIC revealed that Mr. Hernandez does not have a drivers license issued to him. He was asked for proof of insurance and he provided a receipt that he had paid his insurance for the month of March 2005, but did not have proof of liability insurance. Mr. Hernandez was placed under arrest for no drivers license and failure to maintain financial responsibility. Mr. Hernandez was transported to the GPD for booking process and secured in a cell without incident. Case cleared by adult arrest

April 24, 2005

Sr. Patrolman Taylor was traveling westbound patrolling the 2800 block of E. Austin when he observed a white Chevy pickup traveling eastbound at what appeared to be a high rate of speed. Radar confirmed that the vehicle was traveling 57 MPH in a 45 MPH zone. Patrolman Taylor made contact with the vehicle at the 3200 block of E. Austin. The driver was asked for a drivers license and proof of insurance. The driver was ID’d as Joseph Rider. A check through TCIC and NCIC confirmed the Mr. Rider was wanted out of Burnet County for larceny. Mr. Rider was asked to exit the vehicle and was then taken into custody and transported to the GPD where he was processed and secured without incident. Rider was also issued a citation for speeding above the posted limit. Case closed due to warrant arrest/issued citation.

Lexington Police Report


Chief Davis and the Lexington Police Department are busy this week preparing for the upcoming Homecoming events. This year’s Homecoming is expected to be one of the largest yet, even with a chance of rain in the forecast.

Davis advised that ordinances and laws effecting alcohol, and teen drinking will be strictly enforced but is expecting no serious difficulties. “We are hoping that every one comes to the Homecoming festivities and has a great, but safe and responsible time”.

The police department has had several complaints regarding parents releasing passengers and children at the Lexington Middle School. Vehicles approaching the school from Hwy 77 and traveling east on 3rd Street are allowing children out of their cars, placing the children in a position of having to walk across a roadway consisting of three lanes of traffic.

Chief Davis is asking all persons dropping off children to please approach the school from Rockdale Street, or from the west.

The Lexington Police Department continues to receive complaints regarding Garage Sale Signs being posted to utility poles. The Lexington Police Department has begun collecting these signs and contacting responsible persons. The posting of signs on utility poles with staples and nails is illegal and poses a tremendous danger to persons having to service the utilities, or conduct other work on the poles.

April 18, 2005

Chief Davis received a request from Child Protective Services in assistance in removal and placing of children and their mother, following reports of abuse. The incident was handled with no further incident.

April 19, 2005

Chief Davis assisted County Deputy York with information regarding an assault occurring in the county.

Officer Connolly, and the Lexington Fire Department, while attending a fire department meeting received a report from Council person Judy Skolaut, that Lexington Auto Repair, owned by Mark Owens, was on fire. Ms Skolaut reported that she witnessed smoke emerging from the roof area, and an orange glow inside the building. Local police and fire personnel made a quick response, and the local fire department was able to extinguish the blaze with a minimal loose. The State Fire Marshall’s Office was summoned to the scene and determined the cause of the fire was electrical, and starting in the attic of the building.

April 20, 2005

Chief Davis responded to a report of a disturbance located at Petersons Family Foods. Upon arrival Davis was told a man and woman were engaged in an argument outside the store. Witnesses reported the couple left in a vehicle, traveling south on Hwy 77. The couple was not located.

Chief Davis responded to a second report of a disturbance in the 900 blk of Hale Street. Upon police arrival, it was discovered that two teen males became engaged in a physical confrontation after arguing over sports. The fight was broken up, and one of the teens assaulted two adults in the home, by biting and hitting. The teen was found to be extremely agitated, and combative. The teen male was taken into custody and transported to Lee County Sheriffs Department where he was charged with assault causing bodily injury, against a family member.

April 22, 2005

Officer Damewood responded to the Lexington High School regarding a drug dog alerting on a vehicle in the parking lot. The student owning the car was not in the school at the time of the alert.

Officer Damewood received a report of an open door at “The Hill” bar located on 7th Street. Further investigation revealed employees inside the bar, and every thing was alright.

Officer Damewood and Chief Davis received a second call to the Lexington High School regarding a drug dog alerting on a student’s car. The student had returned to school and allowed a search of the vehicle that resulted in the recovery of Marijuana. The matter has been referred to the Lexington Police Department for further investigation.

Officer Damewood received dispatch to a disturbance on 7th street where parents were having difficulty with a child that did not want to be grounded for skipping school. The matter was resolved with out incident.

Officer Connolly received a request to respond to the Lexington Elementary School where a female had lost her car keys. Attempts were made to gain entry to the female’s car. The female was further assisted by local residents.

Officer Connolly received a report of a loud party occurring in the area of the 300 blk of Hester. Upon arrival it was discovered a local teen was having a birthday party under the guidance of parents. No alcohol was involved and a request to lower the noise level was complied with.

Officer Connolly received a report of a teenager on a bike knocking on doors in the 1100 blk of Rockdale. The teen was located, identified and advised.

Officer Connolly received a report of a vehicle in the cemetery with a loud stereo playing. The vehicle was gone on police arrival.

Officer Connolly assisted Lee County officers when a motorist reported traveling through Tanglewood when they were bright lighted by an ATV, and their car was struck by an unknown object, causing minor damage. Two teens were located who reported looking for their dog that had gotten loose, and witnessed the car strike the dog.

Officer Connolly was contacted by a passing motorist who reported safety barrels, located at the construction site on Hwy 77 north, had been moved out into the roadway. Officer Connolly assisted the county by moving the barrels.

April 23, 2005

Officer Damewood received a call to Lexington Food Mart for a vehicle with the keys locked inside. The vehicle had power windows and by policy the vehicle could not be unlocked by police. The local locksmith, Mark Owens was summoned to the scene where the car was successfully unlocked.

April 24, 2005

Officer Damewood received a report of kids playing in the roadway on Simpson Street, posing a danger to traffic. The children were contacted by police and advised not to play in traffic.

Officer Damewood received a report of loud music and kids playing on a 4 wheeled ATV in the street on Caldwell Street. The kids were located riding a 3 wheeled ATV, and advised, along with adults located at the residence d about the ATV and loud music. The request to lower the music and refrain from using the ATV were complied with.

While conducting business checks, Officer Damewood located an open window at Boetcher Enterprises. It was believed illegal entry had not been made and the building was secured.
