Giddings Police Report

- April 11, 2005
Officer Carvin was sent to All Star Convenience at 3250 E. Austin St. in reference to a gas drive off. Upon arrival, Officer Carvin met with the manager who stated that she observed a white Buick 4-door car pull up to the fuel pumps and a black female and a black male exit the vehicle. The black male began pumping the fuel. The black female went into the store and laid a $5 bill on the counter and stated that she wanted to pay for the gas. The manager advised that the total on the fuel pump was at $12 and still fueling. The female then exited the store and got into the vehicle and began pulling away from the pumps. The manager and a customer ran after the vehicle and attempted to stop the suspects, but were unsuccessful. The manager and the customer were able to obtain the license plate before the vehicle left the parking lot. The suspect vehicle fled eastbound. The total amount of fuel not paid for was $16.47. Dispatch ran the license plate, T67-PWN, through the DMV. The vehicle has a registered owner of Rent A Wreck of Houston. A representative of Rent A Wreck gave the name, driver’s license no. and phone numbers of the subject who rented the vehicle, identified as Latanya Eaglin. Mrs. Eaglin was contacted and stated that she had rented the vehicle for her niece and that her niece was supposed to be in Houston. I gave Mrs. Eaglin the contact information for the convenience store and she stated that she would pay for the fuel. The case will remain open until the fuel is paid for.

April 12, 2005
Sgt. Harney was dispatched to 1510 E. Austin St. in reference to a burglary of the building. Upon arrival at the scene, Sgt. Harney met with the Manager, EA Heang and was told that sometime during the night someone broke the lock to the front door and gained access into the business. Once inside the business, someone opened the cash register and took $50 cash which was left inside the till drawer. Mr. Heang advised that he left the key in the key hole on top of the register. Also taken was approximately $150 in change which was located under the donut rack. It appeared that the suspect(s) exited through the back door. Sgt. Harney checked the scene for prints with negative results. There was no other property missing from the business. There is no suspect(s) at this time.

Officer Carvin was dispatched to the Mexican Bakery, located at 1340 E. Austin in reference to a burglary that had occurred overnight. Upon arrival Officer Carvin met with the complainant, Monica Puente, who stated that someone had made entry into the bakery sometime during the night and had stolen $50 in cash that was left in the register. The suspect made entry by removing the faceplate on the dead bolt lock on the front door of the business. The cash was all that was missing from inside the business. Photographs were taken of the damaged dead bolt lock. The total of damages and money stolen is valued at $100. There are currently no suspects, this case is under investigation.

April 13, 2005
Senior Patrolman Taylor met with Gladys Saegert at the GPD in reference to burglary of a vehicle. Ms. Saegert stated that she was at Brookshire Brothers at 9:00 p.m. on 4-12-05, to buy some items. Saegert stated that on April 13, 2005 she noticed that her blue handicap placard was missing from her vehicle. Saegert’s vehicle, a green 1996 Honda Accord was checked by Saegert. She stated that she had not seen the placard since April 12, 2005. A report of the incident was documented and given an incident report number. On April 13, at 3:45 p.m. dispatch advised that Ms. Saegert made contact with the GPD and the handicap placard was located under the driver’s seat of her vehicle. Case closed.

Senior Patrolman Taylor was dispatched in reference to a criminal trespass notice. Dispatch advised that the owner of NAPA located at 289 N. Main St. wanted to criminal trespass two white make subjects identified as Robert Clifford Neal and his son, Matthew Clay Neal. Jon Francis Roberts stated that on April 12th, Neal and his son entered his store wanting to purchase an auto part. Mr. Richards stated that the part was not the part that was agreed upon on the telephone earlier. Richards stated that he and Neal began using profane language. Richards stated that Neal made contact with him over the phone on April 13th advising that he come to his house to settle the situation. Richards stated that he just wanted both Robert and his son Matthew Neal to stay off his store property and both be criminal trespassed. Robert and Matthew Neal both agreed to stay off Richards’ store property. If Richards would not go the their property located in Paige. Criminal Trespass notices were issued and the case was closed.

Officer Valles was patrolling in the 300 block of W. Austin St. when a vehicle traveling east at a high rate of speed was observed. Radar confirmed the vehicle was speeding, 63 MPH in a posted 35 MPH zone. A traffic stop was conducted. The driver, Juan Davila-Caroze of 1126 Gunter St, Austin, advised Officer Valles that he didn’t have a license to drive. Mr. Davila-Caroza was arrested for driving with no valid driver’s license. He was transported to the GPD and booked into the jail without incident. The vehicle was impounded by AJ’s Wrecker. Two passengers, identified as friends of the suspect, who also did not have a driver’s license were given a courtesy transport to a hotel by Officer Law.

April 13, 2005
Senior Patrolman Taylor was notified by dispatch that a black cordless phone was located at the 1400 block of E. Industry. Dispatch advised that the complainant, John Foerster found the phone. He contacted the GPD, turning in the phone. The cordless phone was logged into the evidence room and will remain there until the owner is located or comes to claim the property.

April 14, 2005
Cpl. Ramirez and Officer Crockett were dispatched in reference to a stolen vehicle that was taken from Granny’s in McDade. The vehicle was described as a white 1996 Dodge Caravan bearing license plate X47-CWX with paint peeling. A vehicle fitting that was exiting the Cenex Gas pumps. A check on the license plate returned to the complainant, later identified as Lilah Olmeda. A traffic stop was conducted in the 200 block of W. Austin St. The suspect later identified as James D. Russell, d.o.b 7-7-61, was taken into custody for possession of a stolen vehicle. The vehicle was later recovered by the registered owner. Mr. Russell was transported to the GPD and processed without any further incident.

April 15, 2005
Cpl. Ramirez was traveling eastbound on Austin St. passing the B & W Grocery store located at 1079 E. Austin St., and observed a tan vehicle identified as a 1996 Ford pickup truck bearing TX LP# 7GM-M73 parked in the parking lot and a subject passed out in the Driver’s seat. Cpl. Ramirez approached the vehicle to check the welfare of the driver and the window was rolled down. An open bottle ¾ full of Budweiser Select sitting in the center console, 3 more 12 oz. bottles and a 12 pack of Bud Light cans sitting in the front passenger seat. The driver identified as Rodney Markwardt, was drooling on himself. Officer Crockett and Cpl. Ramirez attempted unsuccessfully to wake him up. EMS was called. Upon their arrival on scene, they attempted to pull Mr. Markwardt out of the vehicle and place him on a stretcher. At that time, he became alert. Mr. Markwardt had a strong odor of an alcoholic beverage emitting from his breath. Mr. Markwardt refused EMS transport, stating that he was fine. Mr. Markwardt would be a danger to himself and others and was placed under arrest for public intoxication. Mr. Markwardt became argumentative and refused to get in the back seat of the patrol care because his vehicle was being towed. After talking with Mr. Markwardt he finally got into the patrol car. Mr. Markwardt was attempting to get out of the back seat of the patrol car and stated that he had to vomit. He was allowed to get out of the car, but did not vomit and again refused to get into the patrol car. After talking with Mr. Markwardt, he complied and got into the patrol car. From that point he was cooperative. Govans Wrecker towed and stored the vehicle. Mr. Markwardt was transported to the GPD for process and was secured in a cell without further incident.

Officer Carvin met with Teresa Jenkins at the Police Department in reference to damage to a vehicle. Ms. Jenkins, who works for Capital Area Rural Transport Systems, had parked her work bus at the library located at 276 N. Orange on Tuesday(4/12) evening at approximately 3:30 pm. When Ms. Jenkins returned to work at 8:15 am, she noticed that the driver’s side mirror had been pushed against the door. Ms. Jenkins took the vehicle to Wilbert’s Tire Shop to get the mirror adjusted. While at Wilbert’s Ms. Jenkins noticed damage to the left hood, left fender and behind the driver’s side door. Ms. Jenkins reported the damage to her employer and then to the Police Department. The damage to the vehicle consists of several scratches to the left hood, fender and broken fiberglass behind the driver’s side door. There was light green paint transfer in the above listed areas. At this time there are no suspects. This case is inactive due to lack of information.

Officer Valles was dispatched to 105 Gaeke St. in reference to telephone harassment. Officer Valles met with Donrell Sanders who stated that approximately 2 hours previously, he received a phone call from a male looking for his stepdaughter. When Mr. Sanders asked who was calling, the caller cursed at him and hung up. Then 45 minutes later, he received a call from the same person. When Mr. Sanders answered, the male subject on the line cursed at him and hung up. The calls continued until Mr. Sanders told the caller he would call the police. Mr. Sanders informed Officer Valles that his caller ID had stored the phone number of the calls. Officer Valles called the number and spoke to Michelle Preston of 448 N. Joekel #17. Ms. Preston stated that she gave her cordless phone to the juvenile next door, due to the juvenile’s mother being in the hospital giving birth. Officer Valles was informed of the juvenile’s identity and went to speak with her. She advised that a friend was at her residence and was in the bathroom for some time but that she never saw him on the phone. Mr. Sanders was informed of the possible identity of the caller. He stated that his step daughter had already found out who it was and that he did not want any charges filed as he planned to speak to the young man’s mother, who he knows well.

April 16, 2005
Officer Valles was patrolling the 1600 block of E. Austin when he observed a white vehicle swerve at a brown vehicle as if to run it off the road. The vehicles were traveling west in the 1600 block of E. Austin. A traffic stop was initiated on the white vehicle by turning on the overhead lights of the patrol car. The white vehicle (1999 Chevrolet 2 door bearing TX LP D59TVK swerved at the brown vehicle(1992 Lincoln 4 door bearing TX LP H99MNV) again. The driver of the Chevy, later know as Yosheka S. Shepard , stuck his head of the window and yelled at the Lincoln. Mr. Shepard then saw my patrol car and pulled over to the left. The Lincoln pulled over right in front of the Chevy and the patrol car. The driver of the Lincoln was identified as Johnny Earl Cooper. Mr. Cooper stated that he didn’t know Mr. Shepard and the Mr. Shepard just tried to wreck into his car. Mr. Shepard was questioned as to why he was attempting to run the Lincoln off the road and he stated that he needed to get his sister out of the car. There was a female passenger in the Lincoln. She was identified and stated that she did not know Mr. Shepard. Mr. Shepard then stated that he was trying to get Mr. Cooper because he is a drug dealer and he sold drugs to his sister. Mr. Shepard was then arrested for reckless driving. He was transported to the GPD and booked into the jail without incident. Mr. Cooper came to the GPD and made a written statement.,

April 17, 2005
Officer Carvin was dispatched to the 500 block of South Leon St. in reference to a hit and run accident that had just occurred. Upon arrival, she met with the complainant, Nellene Spacek, who stated that her parked vehicle had been hit by a white Volvo station wagon while she was in church. The suspect then fled the scene followed by a black Chevrolet SUV. The church services had just commenced and there were numerous witnesses who observed the accident. Several of the witnesses attempted to stop the fleeing vehicle, but were unsuccessful. One of the witnesses followed the vehicle to a convenience store where he observed the driver of the station wagon, described as a white female and the driver of the black SUV, described as a black male with a pony tail, switch vehicles and flee the area traveling eastbound. The witness was able to obtain license plate numbers for both vehicles. Running the license plate numbers through the DMV revealed that both vehicles are registered to Agnieszka Holszanska with an address of 1971 CR 130 in Ledbetter. Lee County Sheriff’s Department was contacted and requested to make contact with that subject at the given address. Photographs were taken of the damaged vehicle and a tail light cover, believed to belong to the suspect vehicle that was recovered at the scene of the accident. Officer Carvin was contacted by Lee County Sheriff’s deputy Mike York who stated that he had made contact with the driver of the station wagon at the above listed address and transported her to the GPD. Mrs. Spacek arrived at the PD at the same time. The driver, identified as Zenora Holszanska, stated that she had attended the Catholic Church, but did not realize that she had struck a vehicle when leaving. Ms. Holszanska, who is visiting from Connecticut, had taken her son-in-law’s station wagon without permission and drove into Giddings this morning to attend church. After the church services were over, Ms. Holszanska began driving home when she was met by her son-in-law Jorge Campuzano. The two then drove to the Chevron to get fuel and switched vehicles. Mr. Campuzano stated that they switched vehicles because the station wagon has severe power steering problems and was difficult for Ms. Holszanska to operate. Insurance information was exchanged between the two parties and the matter will be handled by their insurance companies. Case closed.
