I’ve receive some questions concerning trespassing and hunting without landowner consent. While each case stands on its own merit, each element must be proven. The accusing party must understand the difference between what is criminal and what is civil.
Identification and/or description of suspect (s), method of operation, vehicle description and direction of travel are most important. Knowledge of adjoining property owners, type of activity allowed on adjoining property and whether family or friends have permission to enter are secondary. Witness statements and formal complaint signature by the landowner or their authorized agent may be sufficient to complete the investigation.
