Giddings Police Report

July 20, 2009

At 11:21a.m., Officer Spencer was dispatched to the Dollar General in reference to a prior theft. Martha Vehene reported that two subjects entered the store and then left without paying for a bottle of Sprite. Case under investigation.

July 20, 2009

At approximately 12:22 p.m., Officer Connolly was dispatched to the 200 block of W. Houston St. in reference to a burglary. Upon arrival, Officer Connolly met with Rev. Lang who told Officer Connolly that he checks on this residence weekly and that he observed that two window units were missing from the south side of the residence. This case is under investigation.

July 20, 2009

At approximately 3:15, Officer Connolly was dispatched to the 700 block of N. Chambers in reference to found property. Upon arrival he spoke with the complainant, who advised that she had found a car CD player in her back yard. Officer Connolly collected the car stereo to further investigate this matter.

July 20, 2009

At approximately 11:35 p.m., Sgt. Ramsey and Officer Brewster observed a suspicious male on the side of the Lee County Peanut Mill at the 300 blk of W. Austin. The male was identified as Marcos Lee Foerster. GPD dispatch advised that Foerster was a wanted person out of Lee County. The warrant was confirmed and Foerster was placed under arrest. Foerster was transported to LCSO where he was secured in jail.

July 21, 2009

At approximately 2:24 am, Sgt. Ramirez conducted a traffic stop on a maroon 2003 Dodge pickup truck at the Citgo parking lot located at 791 N. Main St, for Failing to Stop at Designated Stopping Point. The driver, identified as Orlando Rodriguez, Jr. had an odor of an alcoholic beverage emitting from his breath and stated that he had four beers. Rodriguez was issued a citation for DUI by Minor. He was released to a sober adult.

July 21 2009

At 10:08 a.m., Officers Spencer, Connolly and Lt. Harney responded to a reported assault where a subject was bleeding heavily. Upon arrival, Lisa Austin was found walking around inside the residence with a laceration to her head. Austin reported that she was assaulted by her brother who was later found by Lt. Harney. The brother was identified as David Payton. All parties involved were separated and left the scene to seek medical attention.

July 22, 2009

At approximately 3:45 a.m., Sgt. Ramsey, Officer Ray and Officer Brewster responded to a call in reference to assault family violence. The actor was identified as James Adrian James and after investigation was placed under arrest for Assault Family Violence Enhanced w/Previous Conviction and Interference with Emergency Phone Call. James was transported to the LCSO by Deputy Aderhold, where he was secured in jail.

July 23, 2009

At approximately 11:36 p.m., Sgt. Ramirez and Officer Shepard were informed by dispatch that Smithville Police Department had called and asked for a request to apprehend on a wanted subject. The subject is identified as Hilario Luna Espinoza and was located at 773 N. Madison. Lee County Sheriff 's Deputy Garrett Durrenberger assisted in apprehending the subject. Espinoza was located at the residence and placed under arrest for a Parole Warrant and was transported to the Lee County Sheriff's Department Jail for process and secured.

July 24, 2009

At approximately 3:45 p.m., Officer Griffin was dispatched to 447 S. Grimes (Adult Probation Office) in reference to Garrick Lane Faske of Giddings wanting to turn himself in for a Driving While License Invalid warrant. He was taken to the Lee County Sheriff's Office, processed and released to their custody.

July 24, 2009

At 5:42 p.m., Officer Spencer and Officer Griffin were dispatched to 497 S. Polk in reference to a burglary attempt that had just occurred. The victim reported that he was on his porch talking on a phone when Michael Sanders walked up and pushed the victim to the side. Sanders then tried to enter the residence which resulted in a physical altercation. Sanders was found at the intersection of S. Leon and E. Galveston where he was placed under arrest for Burglary of Habitation with Intent to Commit Assault. Keith Sanders arrived at the location of the arrest and interfered with the investigation and Keith Sanders was placed under arrest for Interference with Duties of Public Servant. Another report was received later that Michael Sanders had walked into another apartment without the consent of the owner prior to the burglary report.

July 25, 2009

At approximately 2:41 p.m. Officer Connolly was dispatched to Dollar General Store in reference to a theft. Upon arrival, Officer Connolly spoke with the store manager, who advised police that she observed two B/M subjects under the age of 15 in the store acting suspicious. As the store manager observed the two subjects, they kept looking back at her and moving to different aisles until fleeing the store. The store manager rewound the store security camera footage and observed the subjects putting items down their pants. Around $15 worth of merchandise was stolen. This case is under investigation.

July 25, 2009

At approximately 4:52 p.m., Officer Connolly and Officer Spencer were adviseed by dispatch of a reckless driver heading westbound on E. 290 in a blue Chevy 4-door sedan. The reporting party advised dispatch that the vehicle had turned northbound on 141. Officer Connolly located the vehicle in the 300 blk of E. Independence and conducted a traffic stop in the 2000 blk. of N. Hwy 77. Officer Connolly made contact with the driver while Officer Spencer made contact with the other two subjects in the vehicle. Officer Connolly had consent to search the vehicle and during the search, several illegal items were found, including an open container, crack pipe and a small clear baggy of marijuana. The front right passenger, W/F Sonya Morris of Lexington was placed under arrest for Possession of Marijuana under 2 ounces, and the driver, W/M Ramon Rhodesalso of Lexington was cited for Drug Paraphernalia and Open Container.

July 26, 2009

At approximately 5:02 a.m., Sgt Ramsey, Officer Ray and Officer Brewster received a call in reference to a burglary at Circle W. The officers processed the scene and the investigation is ongoing.

July 27, 2009

At approximately 1:42 p.m., a complainant identified as Michael D. Key, turned in a black wallet he said he found at the intersection of Hwy 77 and 290. The wallet contained the Florida Driver's License and identification of Zayas Yoseny. The wallet also contained an American Airlines boarding pass, a Permanent Resident Card, a Washington Mutual Debit card and a Hialean Public Library card. A young male and female couple that could possibly match the driver's license photo, had been seen earlier taking pictures of the Court House, but they could not be located.

July 27, 2009

At approximately 1:21 a.m., Sgt. Ramsey conducted a traffic stop at the 500 blk of W. Austin. The driver, identified as Terry Tuttle was a wanted person out of Giddings PD for Assault Family Violence Enhanced 3rd degree Felony. Officer Ray assisted with the arrest. Tuttle was transported and secured in a cell at the LCSO.
